1. Agreement to Terms

By accessing or using Text Card's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Text Card provides NFC-enabled review cards and automated SMS reminder services to help businesses collect Google reviews from their customers. Our services include physical NFC cards, SMS automation, and related software tools.

3. Account Registration

To use our services, you must:

• Provide accurate and complete registration information
• Be a legitimate business entity
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

4. SMS Services and Compliance

You agree to comply with all applicable laws regarding SMS communications, including:

• Only sending messages to customers who have explicitly opted in
• Honoring all opt-out requests immediately
• Not using our service for spam or unsolicited messages
• Providing accurate business information for 10DLC registration

You are responsible for ensuring your use of SMS services complies with the Telephone Consumer Protection Act (TCPA) and other applicable regulations.

5. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for recurring fees until you cancel.

• Setup fees are non-refundable
• Monthly subscriptions may be cancelled at any time
• Annual subscriptions are billed upfront for the full year
• Refunds for annual plans are provided on a prorated basis within 30 days

6. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Send fake or incentivized reviews
• Violate Google's review policies
• Attempt to circumvent our systems or security measures
• Resell our services without authorization
• Use our services to harass or harm others

7. Intellectual Property

All content, features, and functionality of our services are owned by Text Card and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our materials without permission.

8. Limitation of Liability

Text Card shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or that they will result in any specific number of reviews.

10. Termination

We may suspend or terminate your access to our services at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use our services will immediately cease.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the updated terms on our website. Your continued use of our services after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
